1. Introduction
Welcome to MotivatingMovement.com, operated by Motivating Movement LLC, located in Pennsylvania, USA. These Terms & Conditions ("Terms") govern your use of our website and services. By accessing or using our website, you agree to be bound by these Terms.
2. Accounts and Registration
To access our services, you must create an account. During registration, you are required to provide accurate and complete information, including your first name, last name, email, phone number, address, and payment information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account.
3. Subscription Plans and Fees
MotivatingMovement.com offers three subscription plans:
• Catalog Plan: $29/month for access to pre-recorded classes.
• Live Plan: $49/month for access to live-streamed classes.
• Best of Both Plan: $69/month for access to both pre-recorded & live-streamed classes.
Additionally, pre-recorded classes can be rented for 24 hours on a one-off basis at $9.99 or $4.99 depending on the duration of the class. Live-streamed classes can also be attended on a one-off basis for $9.99. Users can also access one free live-streamed class by submitting their email address to receive a promo-code which can then be used when booking an appropriate live-streamed class.
4. Live Class Booking
Live classes are generally held Monday/Tuesday/Thursday/Friday at 8:30AM EST and Tuesday/Thursday at 10:30AM EST. Classes will not be held on National Holidays, Personal Vacations or Sick Days. Detailed class calendar with registration capability is available at motivatingmovement.com/live-classes. Individuals wishing to join a live-streamed class (whether a subscriber or not) must register for that class at least 5 minutes prior to start time in order to attend that class. Live classes are conducted via video conferencing applications such as Zoom or Google Meet, with a unique meeting link for each individual class. Registrants can access the video conference link for their respective classes via the “My Classes” section of the website, and a reminder email will be sent to registered individuals 15 minutes prior to start time containing that class’ video conferencing link for convenience.
5. Free Trials and Promotional Offers
We do not currently offer free trials of our subscription plans, but we do offer one free live-streamed class via promo-code when you provide your email address. We also offer a referral promotion which allows new subscribers to receive a 50% discount on their first month’s installment when they subscribe using an existing user’s referral code.
6. Gift Cards
Motivating Movement Gift Cards are not Physical Products, they are delivered electronically to the submitted recipient’s email address. These Gift Cards are available for purchase in the following denominations: $10, $29, $49, $69 and can be redeemed for Individual Live Classes ($10), a Month of our Catalog Plan ($29), a Month of our Live Plan ($49), or a month of our Best of Both Plan ($69). These Gift Cards can NOT be redeemed for individual pre-recorded classes (regardless of duration), as this is a technical limitation of our platform at this time. Any remaining Gift Card value expires 24 months after initial Gift Card creation.
7. Use of the Website
You must be at least 18 years old to use our services. Our services are for individual private use and not for public performance, re-distribution, or re-sale. While we welcome users to work out together in a shared space if possible, each participant must individually agree to all applicable terms/policies, and pay associated costs, whether via subscription or individual class purchase before participating. All users should consult with their doctor before beginning a new fitness regimen.
8. User-Generated Content
Our website does not systematically collect user-generated content, but users can contact us via phone, email, or text and we may choose to use these communications for published testimonials as appropriate. However, during live-streamed classes, conducted via video conferencing applications such as Zoom or Google Meet, subscribers can be on camera, microphone, or use chat functions but this content will not be recorded or published in any way. Users must adhere to the terms & conditions of Zoom and Google Meet to participate in live-streamed classes. Additionally, users must maintain appropriate video-conferencing behavior and attire during live-streamed classes, and we reserve the right to revoke access or terminate membership for inappropriate conduct or attire. Motivating Movement LLC shall not be held liable for the behavior, attire, or other content (nor the impacts therefrom) of users not abiding by the terms of this document.
9. Refunds and Cancellations
Users can cancel their subscriptions on the website and will retain access to subscribed content until the end of the prepaid monthly term under most circumstances. Refunds will not be granted except on a case-by-case basis.
10. Intellectual Property
All content on MotivatingMovement.com, including videos, text, graphics, and logos, is the property of Motivating Movement LLC and is protected by intellectual property laws. Users are prohibited from reproducing, distributing, or creating derivative works from our content without our express written consent
11. Disclaimers
Our fitness advice and services are provided for informational purposes only and are not a substitute for professional medical advice. Users should consult a healthcare provider before starting any fitness program. Users are responsible for maintaining awareness of their environment while taking part in fitness activities. Motivating Movement LLC is not liable for any medical conditions, muscle soreness, fatigue, injury, death, or other adverse situations resulting from engaging in fitness activities. Health and safety are your responsibility, and you should act appropriately and cautiously to ensure your personal safety as well as the safety of others.
12. Dispute Resolution
For any issues, please contact us directly at motivatingmovement.com/contact, and we will work to resolve them in a timely manner. Any disputes that remain unresolved 30 days after either party receives written notice of dispute, shall be resolved by final and binding arbitration before a single arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
13. Periodicity
These Terms & Conditions will be updated from time to time and the continued use of our service is contingent on acceptance of these revised terms.
